WHAT IS DIVORCE MEDIATION?
Divorce mediation is a highly recognized process which results in a Separation Agreement and subsequent divorce.
WHAT IS THE MEDIATOR’S ROLE IN THE PROCESS?
The mediator’s role is to assist the couple in settling all issues necessary to finalize the dissolution of their marriage including custody of their children, financial issues (dividing their property) and how to pay for expenses after the divorce. At Lazar Schwartz & Jones, all mediators are attorney-mediators who are also able to educate couples on the law in New York State. Divorce mediators are neutrals, meaning they do not represent either party.
WHAT ARE THE ADVANTAGES OF CHOOSING DIVORCE MEDIATION?
You Are In Control – By engaging in divorce mediation, the authority for coming to an agreement remains with the divorcing couple. You have control over your settlement. The mediator does not make the decisions – you do. The mediator guides a couple through the necessary issues to be decided.
Other advantages of using divorce mediation include:
• Preserving Relationships – mediation helps end your marriage, not your relationship which is particularly important for families with children;
• Cost – mediation is often the least expensive way to get divorced;
• Speed – mediation is often the fastest way to get divorced;
• Less Intimidating – mediation is a less intimidating process than going to court;
• Long Term Solutions – mediation often leads to a higher commitment to upholding the couple’s agreement down the road;
HOW DOES THE DIVORCE MEDIATION PROCESS WORK?
At Lazar Schwartz & Jones, the average mediation process is completed in 3-6 meetings. The mediator assists the couple in determining what is best for their children and in gathering all the necessary financial information and analyzing it in order engage in discussions and move toward making decisions about how to divide their assets and address support and cash flow issues. Once decisions are reached to the couples’ mutual satisfaction, the mediator prepares a Separation Agreement. Thereafter, once each spouse is satisfied with the Separation Agreement (which may include having their individual attorney review the draft and provide comments), the couple signs the Separation Agreement. The parties can elect to then move forward with obtaining a divorce.
